These terms govern your use of staymx.com, our WhatsApp channels and StayMX's services, operated by ELUL SHALOM, S. de R.L. de C.V. ("StayMX", "we"). By using StayMX you accept these terms. If you don't agree, please don't use the service.
1. What StayMX is
StayMX is a companion for your stay in Mexico: it brings together rentals and homes for sale, local businesses and services, destination and neighborhood guides, and Local Connectors who can help you find your way.
StayMX is not the owner, landlord, real estate agent or provider of what appears on the site, and isn't a party to any agreement you make with them. Unless expressly stated otherwise, we don't process payments for rentals, property purchases or third-party services: you arrange those directly with the owner or provider.
2. Properties, businesses and Local Connectors
Information about each property, business or connector is provided by them or gathered from public sources. We review some of it, but we don't guarantee that it's accurate, complete or current, or the quality, legality or availability of what's offered.
Before paying a deposit, signing a contract or hiring a service, verify the other party's identity, the property and the terms yourself. Never send money for a property you haven't seen or whose ownership you haven't confirmed.
Local Connectors and businesses are independent of StayMX; they aren't our employees or representatives. A "verified" badge means we checked certain details at a point in time, not that we endorse or guarantee their work.
StayMX may receive a commission or fee from some businesses, properties or perks on the site. That doesn't change the price you pay.
3. Guides and informational content
Guides, recommendations and the assistant's answers are general information. They may contain errors or become outdated, and they aren't legal, immigration, tax, medical or financial advice. For important decisions, consult a professional.
4. Accounts
Some features need an account. You're responsible for keeping your account details accurate and your password secret. Tell us right away if you think someone else is using your account.
We may suspend or close accounts that break these terms or put other users at risk.
5. Content you post
If you post a property, a business, a review, a photo or a community post, you confirm that you have the right to do so and that the information is true. You keep ownership of your content and give us a free, non-exclusive license to display, adapt and share it within StayMX and its partner sites, such as Renta Puerto Escondido and Renta Lake Chapala.
We may edit, hide or remove content that is false, misleading, offensive, illegal or breaks these terms.
6. Perks and vouchers
Perks (discounts, vouchers and promotions) are offered and honored by each business, on the conditions shown with each one. The business may change or withdraw them. StayMX isn't responsible if a business doesn't honor a perk, but please tell us so we can act on it.
7. StayMX's paid services
Some StayMX services, such as the guided plans, cost money. Before you pay, we tell you the price and what's included. Payments are processed by Stripe; StayMX never receives or stores your card details.
If you have a problem with a service you paid for, write to hello@staymx.com and we'll work it out with you.
8. WhatsApp and communications
When you message us on WhatsApp, you agree that we can reply there. The first message you get may be an automatic reply; after that a person from the team takes over.
We'll only message you about your requests or things you've agreed to receive. You can ask us to stop messaging you at any time.
9. Acceptable use
When using StayMX, you agree not to:
- Post false information, impersonate another person or business, or offer properties or services you have no right to offer.
- Use the site for fraud, spam, or to contact users for purposes unrelated to StayMX.
- Copy or scrape the site's content in bulk, or interfere with how it works or its security.
- Post content that is illegal, discriminatory, violent or infringes the rights of others.
10. Liability
StayMX is provided "as is". We do our best to keep it working well and its information useful, but we don't guarantee the service will be free of errors or interruptions.
To the extent the law allows, StayMX isn't responsible for the acts or omissions of owners, businesses, Local Connectors or other users, or for agreements, payments or disputes between you and them.
Nothing in these terms limits your rights under Mexico's Federal Consumer Protection Law or any other law that can't be waived.
11. Privacy
How we handle your personal data is described in our Privacy Notice at staymx.com/aviso-de-privacidad.
12. Changes to these terms
We may update these terms. We'll post any change on this page with the date of the last update. If you keep using StayMX after a change, you accept it.
13. Governing law and contact
These terms are governed by the laws of Mexico. Any dispute will be handled by the competent courts of Guadalajara, Jalisco, without prejudice to your rights as a consumer.
